The Employers Liability (Compulsory Insurance) Act 1969 places a compulsory duty on employers to have this insurance because they are required by the Act to insure against liability for injury or disease to employees during their work. It is a criminal offence if a policy is not provided.
The employee may claim for an injury or illness against the company if they believe them to be responsible.
Employers Liability Insurance will enable the employer to meet the cost of any compensation for a civil claim. The certificate of insurance must be kept by the employer and displayed in a prominent position at the workplace or provided to employees either in hard or electronic copy for them to view.
Quest Health & Safety Prosecution Insurance covers the costs of legal fees, cost and expenses incurred by a consultant defending a criminal prosecution arising from health and safety at work, occupational hygiene and food safety hygiene.
Health & Safety Prosecution Insurance can also cover the carriage of dangerous goods and an appeal against the serving of an enforcement notice under the Health & Safety at Work etc. Act 1974 if appropriate.
